Voluntary Surrender of Estate
In the event that you are unable to pay your debts but you have assets (i.e. a vehicle or furniture, etc) the solution may be to apply for the voluntary surrender of your estate In most cases you will be able to keep all your assets and decrease your debt by around seventy five percent. The voluntary surrender of your estate could protect your assets from your creditors and allow you to chose your own timeline (24 or 36 months) in paying the other twenty percent.
This is a legal process that takes place by order of the High Court of South Africa at which stage you are returned to your previous status as before the voluntary surrender of your estate. This application may be brought to the High Court after 3 – 4 years after the voluntary surrender of your estate / sequestration has taken place
